IN THE HIGH COURT OF HIMACHAL PRADESH, SHIMLA

CWP No. 2463 of 2017

Decided on: 28.12.2017

Hans Raj

.......Petitioner.

Versus

H.P. State Electricity Board Ltd. and others.

…...Respondents

Coram

The Hon’ble Mr. Justice Dharam Chand Chaudhary, Judge. The Hon’ble Mr. Justice Sandeep Sharma, Judge.

Whether approved for reporting?[1] No.

For the petitioner:

Mr. Kul Bhushan Khajuria, Advocate.

For the respondents:

Mr. Satyen Vaidya, Sr. Advocate with Mr. Vivek Sharma, Advocate for respondents No. 1 and 2.

Mr. Avinash Jaryal, Advocate for respondent No.3. respondent No.3.

Dharam Chand Chaudhary, Judge (Oral)

The order under challenge in this writ petition is Annexure P-3 dated 25.10.2017, whereby learned Tribunal has only issued the notices to the respondents and sought their replies within a week to the original and sought their replies within a week to the original application. On behalf of the petitioner-original applicant though, it has been canvassed that learned Tribunal has declined the interim relief, however, such contentions are not supported by record for the reason 1 Whether the reporters of Local Papers may be allowed to see the judgment? Yes.

that nothing is there in the impugned order that the interim relief has been declined. Learned Tribunal rather has directed the respondents to file reply within a week. The writ petition, as such, is pre-mature at this stage. Being so, the same is dismissed. The petitioner-original applicant may agitate the matter before learned Tribunal for grant of interim relief. We hope and trust that learned Tribunal shall take up the application filed for grant of interim relief at the earliest, preferably before winter vacations.

2. The writ petition is accordingly disposed of. Pending application(s), if any, shall also stand disposed of.
