Petitioner, who is working as Female Health Worker, in terms of impugned order of transfer dated 28.9.2013 (Annexure P-2) stands transferred to HSC Balhara. The transfer of the petitioner has been effected on the basis of D.O. note obtained from the Health Minister.
2. In these circumstances, we find that the case of the petitioner is squarely covered by the decision of this Court in CWP No. 801 of 2013, titled as Sanjay Kumar Vs. State of H.P. and others, along with connected matters, decided on 5.7.2013. We accordingly quash and set aside transfer order dated 28.9.2013 (Annexure P-2), so far it effects the transfer of the petitioner. We Whether the reporters of the local papers may be allowed to see the Judgment? No.
leave it open to the respondents to transfer the petitioner in accordance with law. Liberty is granted to the State to take action in accordance with law.
With the aforesaid observations, present petition stands disposed of, so also, the pending application(s), if any.
