ORAL JUDGEMENT
Heard Ms. Sutaria for Mr. Desai for the petitioner. She has submitted that in this petition, the petitioner has challenged the interim order passed by the Gujarat Primary Education Tribunal in application NO. 39 of 2000 dated 12th May, 2000. She has further submitted that the tribunal has granted interim relief against the order of termination dated 25.4.2000. She has submitted that the main matter being application no. 39 of 2000 is still pending before the tribunal wherein the termination is under challenge. In view of these facts, learned advocate Ms. Sutaria has submitted that this petition could be disposed of by issuing some suitable directions to the tribunal to decide and dispose of the main application within reasonable period.
I have heard the arguments of the learned advocate Ms. Sutaria for the petitioner, learned AGP Mr. Pandya for respondent No. 2 and Mr. Prashant G. Desai for respondent NO.3. Considering the submissions made by Ms. Sutaria, when the challenge against the termination order is pending before the tribunal in the main application no. 39 of 2000, it would be just and proper to dispose of this petition by directing the tribunal to decide and dispose of the said main application finally within three months from the date of receipt of writ of this order.
Accordingly, the Gujarat Primary Education Tribunal is directed to decide and dispose of the application NO. 39 of 2000 in accordance with law within three months from the date of receipt of certified copy of this order. With these directions, this petition is disposed of. Rule is made absolute in terms indicated hereinabove with no order as to costs.
