ORAL ORDER

The learned counsel for petitioners submits that on 30th May, 1996, BIFR recommended for winding up of the petitioner No.2-Company. That order has been challenged by petitioners before the AAFIR but that appeal came to be dismissed on 7th April 1997. So in view of the aforesaid fact, the petitioner No.2-Company was recommended by BIFR for winding up and the learned counsel for the petitioners admits that winding up proceedings of the petitioner No.2-Company are pending before this Court. The learned counsel for petitioners submits that he will advise his clients to appear before the Winding-up Court and raise all the objections which have been raised in this Special Civil Application and to do so he prays for withdrawal of this Special Civil Application.
