ORAL JUDGEMENT
Heard learned advocate Ms.Madhu Sharma for the petitioner and Mr. Ghori, learned AGP for the respondents. Mention of this matter was made by the learned advocate Ms. Sharma when other petition being special civil application no. 1807 of 1992 was taken up for hearing by this court on 19th December, 2003. According to her submission made on that day, this matter is also identical to special civil application no. 1807 of 1992 and, therefore, considering her mention, office was directed today to place the papers of the present special civil application before this court and office has placed the papers of the present petition before this court. It was the submission made by Ms. Sharma that this petition may also be disposed of in terms of the order passed by this Court in Special Civil Application No. 1807 of 1992 dated 19th December, 2003.
I have considered the submissions made by the learned advocate Ms. Sharma that the case of the petitioner for the post of Forest Guard has not been considered by the department though he was called for interview. I have also considered her grievance that there is no positive reply that the petitioner is not suitable for the post of Forest Guard. Learned advocate Ms. Sharma submitted that on various occasions, representations were made by the petitioner to the respondents with a request to consider his case for the post of Forest Guard at par with other similarly situated employees whose cases have been considered by the department.
In view of this fact, considering her
submissions, it is directed to the respondents to reconsider the case of the petitioner for the post of Forest Guard and pass appropriate orders in accordance with rules and regulations within one week from the date of receipt of copy of this order.
In view of these observations and directions, this petition is disposed of. Rule is discharged. Interim relief, if any, shall stand vacated. There shall be no order as to costs.
