The petitioner filed an application Exh. 27 on 06.11.2004 seeking leave to file written statement. This Court has remanded the matter to the Trial Court to reconsider the injunction application by an order dated 14.12.2004. In the for the respective parties and after having gone through the memo of petition and the relevant documents produced before the Court, the Court is of the view that the petitioner has filed an application at Exh. 27 on 06.11.2004. The said application was not heard by the Trial Court. In the

Before the said application is heard, the petitioner has filed one more application Exh.37 before the Trial Court to hear its application Exh.27 to take written statement on record. Even chronologically the sequence of events, if considered, the application Exh. 27 is required to be heard first and even otherwise, to appreciate the real controversy between the parties, the application to take the written statement on record is required to be heard first. The Court, therefore, directs the Trial Court to hear the application Exh. 27 filed by the petitioner to take the written statement on record and thereafter, the injunction application may be heard. Since the suit is of 1988, the Trial Court is directed to hear the application Exh. 27 within two months from the date of receipt of writ or from the date of receipt of this order, whichever is earlier.

Parties to the suit are directed to co-operate the Trial Court in disposal of the application within time fixed by the Court.
