CIVIL APPEAL 642 of 2008 on 21 October 2008

Heard learned Additional Government Advocate. None appears on behalf of the petitioner as well as opposite party nos. 2 to 8.

This is an application for cancellation of order dated 21.10.2008 passed by the learned J.M.F.C., Chandikhole in G.R. Case No. 642 of 2008 pursuant to the order dated 13.10.2008 passed by this Court in ABLAPL No. 13406 of 2008 directing the release of the petitioner on bail, on his surrendering in the said case.

Considering the submission made and on going through the petition averments as well as the order dated 13.10.2008, further viewing the factum of lapse of more than 9 and half years since the order as aforesaid, the application stands dismissed.
