[1.0]RULE. Learned APP waives service of rule for the respondent-State.[2.0]The present application has been preferred by the applicant torelease him on temporary bail on the ground of wife’s delivery.

[3.0]Learned APP draws attention of this Court to the jail report toindicate that the applicant is an under-trial prisoner and he is in jail sinceJune, 2022 and was lastly released in March, 2024 and surrendered in time.Further, the jail conduct of the applicant – under-trial prisoner is reported tobe good.

[4.0]Taking into consideration the grounds urged in this application, theapplicant-under-trial prisoner is ordered to be released on temporary bailfor a period of TWO DAYS from the date of his actual release on theapplicant’s furnishing personal bond of Rs.5,000/- to the satisfaction of theconcerned authority, on usual terms and conditions.

[5.0]The applicant-under-trial prisoner shall surrender before theconcerned jail authority on expiry of the temporary bail period. Noextension of temporary bail shall be granted. Rule is made absoluteaccordingly.
