CORAM:

JUSTICE DIXIT KRISHNA SHRIPAD

ORDER13.10.2025

Order No. Petitioner has made a representation to the 01 Director, Higher Secondary Education, Odisha at Annexure-4 wherein he has requested for release of arrears of salary for the period between 01.06.1994 and 18.07.2010.

Learned counsel for the petitioner submits that a Coordinate Bench of this Court in W.P.(C) No.15658 of 2020 etc. disposed off on 21.04.2023 has accorded benefits to the employees of the kind and that the said order has been affirmed by a Division Bench in W.A. No.1350 of 2024 disposed of on 17.07.2025. He submits that if the said representation is considered in the light of the said decisions, in a time bound way, his client would be satisfied.

Learned ASC, appearing for the opposite parties, fairly agrees with the suggestion of this Court that the opposite party no.2 would look into the grievance of the petitioner, as has been aired in the subject representation, keeping in view the law, rules, circulars and the decisions cited at the Bar, if a reasonable period is prescribed and all contentions of the parties are kept open. With this, learned counsel for the petitioner is agreeable.

In the above circumstances, writ petition is disposed off directing opposite party no.2 to consider the subject representation of the petitioner as at Annexure-4 and dispose of the same in accordance with law within an outer limit of eight (8) weeks. All contentions of the parties are kept open.

It is open to the answering opposite party to solicit any information or document from the side of the petitioner, as required for taking a decision on the subject representation. However, in that guise, delay shall not be brooked.

Now, no costs.

Web copy of order to be acted upon by all concerned.
