ORAL JUDGEMENT

These applications are filed for appointment of arbitrator under Section 11 of the Arbitration and Conciliation Act, 1996 (hereinafter referred to as `Act'). Notice was issued by this Court pursuant to which the respondents have appeared.

I have heard, at length, learned counsel for the parties.

Almost in similar circumstances, on November 5, 1999 in Arbitration Petition No. 10 of 1998, an order was passed and direction was issued that an arbitration to be named by the General Manager, Western Railway may be appointed.

It is not disputed by and between the parties that cases on hand are also similar to that of Arbitration Petition No. 10 of 1998.

In the circumstances, following the order dated November 5, 1999 in Arbitration Petition No. 10 of 1998, it is directed that General Manager, Western Railway will appoint one arbitrator. Final order will be passed within two weeks from receipt of the writ.

Accordingly, all petitions are disposed of. No order as to costs.
