It is stated by learned Addl. Government Advocate for the State, which is supported by an affidavit filed in the Registry, a copy of which was produced before us but not tagged to the file, that the victim girl has been rescued on 31.12.2018 from village Nagendraganj under Sagar Police Station in the district of South 24 Pragana, West Bengal and after producing the same before the learned Addl. Sessions Judge-cum-Special Judge, Jagatsinghpur and recording her statement under Section 164 of Cr.P.C. she has been handed over to her parents on 3.1.2019.

In that view of the matter, there is hardly any scope for this Court to proceed with the application for habeas corpus. Accordingly, the prayer made in the W.P.(Crl) for habeas corpus has become infructuous and disposed of as such.

The registry is directed to trace out the affidavit filed by the I.I.C., Paradeep Police Station, Paradeep, District-Jagatsinghpur and tag the same to the file.
