ORAL JUDGEMENT

This civil revision application arises from the order of Extra Assistant Judge, Junagadh dated 27-1-1992 passed below Ex.5 in Civil Misc. Appeal No.4 of 1992. So only interim temporary injunction has been granted by the appellate court pending the disposal of the appeal. This revision application has come up for admission before this Court on 13-2-1992 and same has been admitted and interim relief in terms of Para No.6 (b) was granted. This court has further ordered that this order will not amount to stay of final hearing of the Civil Misc. Appeal No.4/92 which may be decided as early as possible. The Civil Misc. Appeal is of 1992 and in the matter of grant of temporary injunction, there is all possibility that by now that appeal itself would have been disposed of. Unfortunately, none of the counsel for the parties is present. Be that as it may.

The interim relief which has been granted by this Court on 13-2-1992 shall continue till the decision of the Civil Misc. Appeal No.4 of 1992. The first appellate court is directed to decide the appeal within a period of two months from the date of receipt of writ of this order. In case that appeal has already been decided then this order needs not to be complied with and interim relief which has been granted by this Court shall stand vacated automatically without reference to the Court. The civil revision application and Rule stand disposed of accordingly with no order as to costs.
