ORAL JUDGEMENT

Heard learned advocate Mr. P.K. Jani for the petitioners; Mr. H.C. Patel, learned AGP for the respondent authorities and Mr. P.J. Vyas, learned advocate for respondent NO. 1 and 2. This petition was admitted by this court by issuing rule thereon 27th December, 1999 and it was ordered to be heard with Special Civil Application No. 1199 of 1993.

Today, when this petition was called out, learned advocate Mr. P.k. Jani appearing for the petitioner has made a statement that in respect of the subject matter of this petition, there is a compromise between the parties out side the court and, therefore, he seeks leave to withdraw this petition unconditionally. He has produced letter of the petitioner Rasiklal L. Thakar dated 19.11.2002 wherein the petitioner Rasiklal L. Thakar has requested Mr. P.K. Jani to withdraw Special Civil Application No. 9380 of 1999. Said letter of the petitioner produced by Mr. Jani is ordered to be taken on record of this petition.

Considering the contents of the letter dated 19.11.2002 of the petitioner and also considering the submissions made by Mr. Jani, leave to withdraw this petition unconditionally is granted. This petition is disposed of as withdrawn unconditionally. Rule is discharged. Interim relief, if any, shall stand vacated with no order as to costs.
