Date of decision: 06/11/96

ORAL JUDGEMENT

Mr.Shukla has pointed out that this is a second petition challenging the detention order dated 27.4.1996 passed by the District Magistrate, Bharuch. The detention order had already been revoked, Rule is discharged way back on 4.9.1996 and therefore even first Special Civil Application No. 5136 of 1996 has been dismissed today as having become infructuous, this being second petition against the same order does not lie and even otherwise it is futile to consider the validity of the detention order because the same has already been revoked by the Government.

This Special Civil Application is accordingly dismissed as futile and Rule is hereby discharged.
