1. This matter is taken up through hybrid mode.

2. Heard learned counsel for the petitioner and learned Addl. Standing counsel for the State.

3. The petitioner is apprehending arrest in connection with Bhuban P.S. Case No. 471 of 2023 corresponding to G.R. Case No. 453 of 2023 pending in the court of the learned JMFC, Bhuban for the alleged commission of offence under Sections 143/147/148/341/342/294/323/307/427/379/506/149 of IPC and r/w Sections 25/27 of Arms Act.

4. It is alleged that the petitioner along with several other persons assaulted the informant after tying him to an electric pole and also threatened him by showing a pistol. Several co-accused persons have been released on bail by the court below. The petitioner stands on the same footing.

5. Considering the nature of accusations and also the materials on record while not being inclined to grant anticipatory bail to the petitioner, the ABLAPL is disposed of granting liberty to the petitioner to surrender before the court below within two weeks from the date of receipt of certified copy of this order and to move for bail. In such event, he shall be released on bail on such terms and conditions as the court below may deem fit and proper to impose.

6. The ABLAPL is accordingly disposed of.

7. Issue urgent certified copy as per rules.
