1. This matter is taken up through hybrid mode.

2. Heard learned counsel for the petitioner and learned Addl. Standing Counsel for the State.

3. The petitioner is apprehending arrest in connection with Baselisahi P.S. Case No.266 of 2023 corresponding to G.R. Case No.849 of 2023 pending in the Court of the learned JMFC(Cog-II), Puri for the alleged commission of offence under sections 341/323/325/307/394 and 34 of IPC.

4. It is alleged that the petitioner and some other persons assaulted the informant and his friend causing injuries and also snatched away cash of Rs.4,000/- and two mobile phones.

5. Considering the nature of accusations and also the materials on record, while not being inclined to grant anticipatory bail to the petitioner, the ABLAPL is disposed of granting liberty to the petitioner to surrender before the Court below within two weeks from the date of receipt of certified copy of this order and to move for bail. In such event, he shall be released on bail on such terms and conditions as the Court below may deem fit and proper to impose. It is clarified that this order shall be operative only if the injuries are found to be simple in nature.

6. The ABLAPL is accordingly disposed of.

7. Issue urgent certified copy as per rules.
