ORDER:-
This petition is filed under Section 438 of the Code of Criminal Procedure, 1973 (for short “Cr.P.C.”) seeking pre-arrest bail to the petitioner/accused in the event of his arrest in connection with Crime No. 222 of 2021 of Gajulamandyam Police Station, Tirupathi Urban, registered for the offencse punishable under Sections 307, 436, 342, 427, 452, 506 of IPC.
2. Heard learned counsel for the petitioner and learned Assistant Public Prosecutor for the respondent-State.
3. Learned counsel for the petitioner submits that petitioner is innocent and no way connected to this crime, as such petitioner’s case may be considered for grant of pre-arrest bail.
4. Learned Assistant Public Prosecutor submits that there are specific allegations against the petitioner and investigation is pending, as such he is not entitled for bail at this stage.
5. In view of the specific allegations made against the petitioner, this Court is not inclined to grant pre-arrest bail to him. However, liberty is given to the petitioner to surrender before the concerned jurisdictional Court and move an appropriate application seeking bail. On such surrender, the application moved by the petitioner shall be considered on the same day, in accordance with law.
6. Accordingly, this Criminal Petition is disposed of.
Consequently, miscellaneous applications pending, if any, shall stand closed.
