ThisWritPetitionisfiledunderArticle226oftheConstitution’ofIndiaseekingthefollowingrelief; atoissueaWrit,OrderorDirectionmoreparticularly,oneinthenatureofWritofMandamusdeclaringtheinactionoftherespondents,particularlyrespondentNos.3to6innotreappointingthepetitionerasasanitaryworkerattheMandalPrajaParsihadPrmaryschool,B.C.Colony,Ulchala.Village,KumoolMandal,KumoolDistrictaspatentlyillegal,arbitrary

Thecaseofthepetitioner,isthatthepetitionerisworkingasSanitaryworkerfrom01.10.2014andhewasbeingpaidRs.2000/-permonthasanhonorarium.Subsequently,eventhoughthehonorariumwassanctionedbytheS*"**respondentherein,thepetitionerwasnotpaidanyhonorariumforaperiodoftenmonthsfromDecember2017toOctober,2018.Forwhich,thepetitionerapproachedthe5*^respondenti.e.,theHeadMasteroftheMPPschoolandrequestedseveraltimes,topaythehonorariumforthesaidperiod,but,withoutpayingthesame,theSchoolauthoritiesengagedtheservicesofanother sanitaryworkeri.e.,the7*respondentherein,inplaceofthepetitioner.

ThepetitionerapproachedtheAndhraPradeshHumanRightsCommission(APHRC)andlodgedacomplaintagainsttherespondents.TheAPHRCvideitsorderdated08.09.2021inRightsCommission(APHRC)andlodgedacomplaintagainsttherespondents.TheAPHRCvideitsorderdated08.09.2021in HRC85of2021directedtherespondentstoexaminethecaseofthepetitioneranddotheneedfulandprovideemploymentasSanitaryworkerinsomeschoolwithintheKurnoolMandal,preferablyinaschoolnearertoherplaceofresidenceandalsoarrangetopaytoher,thearrearsofsalary,ifanysucharrearsarepayable.Inpursuanceoftheabovedirections,thepetitionerwaspaidanamountofINR19,500/-bytherespondentshereintowardshonorarium.However,thepetitionerwasnotreappointedasaSanitaryworker.Hence,thepetitioneragainapproachedAPHRCandfiledanothercomplaintinHRCNo.285of2021,whereintheAPHRCpassedorderson20.09.2022,withthefollowingdirections.

Conclusion

“Wehavegonethroughthewrittensubmissionsfiledonbehalfofthecomplainant,whereinsheonceagainmadearequestforherreappointmentinthesameschool,ifnecessary,bytransferringthe4''’respondent,whoisappointedinherplace,tosomeotherSchoolorInstitution,ifnecessary,inconsultationwiththeSuperiorofficersanddotheneedfultoprovideemploymentto hereitherinthepostofasaSanitaryWorkeroranyothersuitablepostwithinKurnoolMandal,preferablyinaSchoolorInstitutionlocatesnearertoherplaceofresidence.

Therespondentsshallcommencethenecessaryexerciseintheaboveregardwithintwoweeksfromthedateofreceiptofacopyofthisorderandcompletethewholeexercisewithinfourweeksthereafterandinformtheoutcometothepetitionerinwritingwithinaweekthereafter,toenablehertopursuefurthercourseofaction,ifnecessary.

Accordingly,thecaseisdisposedofwiththeabovedirection.”

4. InspiteoftheabovesaidorderspassedbytheAPHRC,astherespondentsfailedtoconsiderthecaseofthepetitionerfortherespondentsfailedtoconsiderthecaseofthepetitionerfor reappointmentasaSanitaryWorker,thepetitionerfiledthepresentWritPetition.

5. WhentheWritPetitioncameupforadmissionon 04.04.2023,thiscourtpassedthefollowinginterimorder:

“Inthemeantime,theWritPetitionerisdirectedtosubmitafreshRepresentationtotheRespondentNo.3throughtheHeadMaster/Headmistress(RespondentNo.5)withinaweekfromtoday.UponsubmissionofsuchRepresentation,theCompetentAuthorityshallconsiderandpassaSpeakingOrderwithintwo(02)weeksfromthedateofsubmissionoftheRepresentationandcommunicatethesametotheWritPetitionerforthwithandalsofilecopyoftheOrderonthefileofthisCourtbeforethenextdateofhearing.”

6. The3rdrespondentfiledcounterandsubmittedthataspertheordersdated04.04.2023,thepetitionerhasnotsubmittedanyfreshrepresentationthroughtheHeadmastertothe3rdrespondenttilldate,fortakingfurthercourseofactioninthisregard.Itisfurthersubmittedthatthepetitionerhasnotshownanyinteresttomakefreshrepresentationtothe3rdrespondentaspertheordersoftheCourt.theordersdated04.04.2023,thepetitionerhasnotsubmittedanyfreshrepresentationthroughtheHeadmastertothe3rdrespondenttilldate,fortakingfurthercourseofactioninthisregard.Itisfurthersubmittedthatthepetitionerhasnotshownanyinteresttomakefreshrepresentationtothe3rdrespondentaspertheordersoftheCourt.

Ontheotherhand,learnedcounselforthepetitionersubmitsthatduetosomepersonalreasons,thepetitionercouldnotmakefreshrepresentationwithintime,asdirectedbythiscourton04.04.2023andrequestedtodisposeoftheWritPetition,bymakingtheinterimordersasfinalorders.submitsthatduetosomepersonalreasons,thepetitionercouldnotmakefreshrepresentationwithintime,asdirectedbythiscourton04.04.2023andrequestedtodisposeoftheWritPetition,bymakingtheinterimordersasfinalorders.

8. ConsideringtheabovesubmissionsandinviewoftheinterimorderspassedbythisCourton04.04.2023,thepetitionerisdirectedtosubmitafreshrepresentationtotheRespondentNo.3throughtheHeadMaster/Headmistress(RespondentNo.5)withintwo(02)weeksfromtoday.Onreceiptofthesame,theCompetentAuthorityshallconsiderandpassaSpeakingOrderwithintwo(02)weeksfromthedateofsubmissionoftherepresentationandcommunicatethesametotheWritPetitionerforthwith.interimorderspassedbythisCourton04.04.2023,thepetitionerisdirectedtosubmitafreshrepresentationtotheRespondentNo.3throughtheHeadMaster/Headmistress(RespondentNo.5)withintwo(02)weeksfromtoday.Onreceiptofthesame,theCompetentAuthorityshallconsiderandpassaSpeakingOrderwithintwo(02)weeksfromthedateofsubmissionoftherepresentationandcommunicatethesametotheWritPetitionerforthwith.

9. Withtheabovedirection,theWritPetitionisdisposedofThereshallbenoorderastocosts.

Asasequel,miscellaneousapplicationspending,ifany, shallalsostandclosed.
