ORDER:
The petitioner is accused in Crime No.215/2022 on the file of the Duggirala Police Station, Guntur District, for offences under Sections 342, 420, 509, 506 of Indian Penal Code and 3 (1)(r)(s), 3(2)(va) of the SC and ST Prevention of Atrocities Act, 1989.
2. The Petitioner has approached this Court with the contention that the said allegations are untrue and a false case -has been filed against the petitioner by the de factocomplainant, for the purposes of obtaining final resolution of a dispute between the two of them in relation to payment of some money due to the petitioner.
3. Sri Karumanchi Indraneel Babu, the learned counsel appearing for the petitioner submits that the complaint at the stage of investigation needs to be quashed on above ground.
4. A perusal of the complaint shows that there are allegations which require to be gone into. The veracity of the allegations would have to be ascertained by way of an investigation and it would not be appropriate for this Court to stop the investigation at this stage.
5. Accordingly, this complaint is dismissed. However, the petitioner shall be entitled to a benefit of notice under Section 41-A of Cr.P.C before any further steps are taken against him.
Miscellaneous petitions, pending if any, in this Criminal Petition shall stand closed.
