ORDER:-
This Criminal Petition is filed by the petitioners/A-2 and A-3 under Section 482 of the Criminal Procedure Code, 1973 to quash the proceedings in F.I.R.No.320 of 2019, dated 12.09.2019, on the file of Badvel (U) Police Station, Kadapa District.
2. At the time when the matter is taken up for hearing, learned Public Prosecutor states that the police have investigated into the matter and filed charge sheet for the offences punishable under Sections 498-A read with 34 I.P.C. and Sections 3 and 4 of the Dowry Prohibition Act, 1961 and the same is also taken on file.
3. At this stage, learned counsel for the petitioners would submit that the presence of the petitioners before the trial Court may be dispensed with as there is no dispute with regard to their identity.
4. The same is not seriously opposed by the learned Public Prosecutor as there is no dispute with regard to the identity of the petitioners.
5. Having regard to the facts and circumstances of the case and as there is no dispute with regard to their identity, the petitioners/A-2 and A-3 shall appear once before the trial Court and thereafter, their presence before the trial Court in the C.C. is dispensed with except on the dates when their appearance is required by the trial Court.
6. With the above observation, the Criminal Petition is disposed of.
Miscellaneous petitions pending, if any, in this Criminal Petition shall stand closed.
