THE HON’BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.30312 OF 2021

ORDER:-

Heard Sri P.R.K.Amarendra Kumar, learned counsel for the petitioner and P.Subash, learned Government Pleader for respondents.

Precisely, the grievance of the petitioner in the present Writ Petition is that the 3[rd] respondent is attempting to evict the petitioner from the land admeasuring Ac.1.99 cents in R.S.No.173/1 of Swarnavarigudem Village, Jeelugumilli Mandal, West Godavari District without recourse to law.

According to the learned counsel for the petitioner, the said action is sought to be resorted to by the 3[rd]respondent without issuing any notice to the petitioner and the same is violative of Articles 14 and 21 of the Constitution of India. Along with the Writ Petition an extract of Adangal generated on 27.11.2021 is filed for fasli 1431, which indicates in column 13, the name of the husband of the petitioner, who passed away on 22.07.2021. In fact, in order to show the same, the death certificate issued by the Gram Panchayat is also filed. In addition to the Adangal referred supra, the petitioner herein has also made available along with the Writ Petition an extract of Form 1B issued in

27.11.2021 which is standing in the name of the husband of the petitioner herein.

In view of the above documents and keeping in view the submissions of the learned counsel for the petitioner and the learned Government Pleader for Revenue, the Writ Petition is disposed of, directing the respondents herein not to interfere with the possession and enjoyment in respect of the subject property. However, it is made clear that the respondents are entitled to take action, strictly in accordance with law. There shall be no order as to costs.

Miscellaneous Petitions pending, if any, in this Writ Petition shall stand closed.
