IN THE HIGH COURT OF ANDHRA PRADESH AT AMARAVATI (Special Original Jurisdiction)

[3310]

TUESDAY ,THE THIRTY FIRST DAY OF DECEMBER TWO THOUSAND AND TWENTY FOUR

PRESENT

THE HONOURABLE DR JUSTICE K MANMADHA RAOWRIT PETITION NO: 31306/2015

Between:

Nr.simhachalam W/o Late Mugada Rama Suri ...PETITIONER

AND

State Of Andhra Pradesh and Others

...RESPONDENT(S)

Counsel for the Petitioner:

1. A JAGANNADHA RAO

Counsel for the Respondent(S):

1. GP FOR ENDOWMENTS (AP)

The Court made the following Order:

The Writ Petition is filed under Article 226 of the Constitution of India, seeking the following relief:

“…..to issue a writ of mandamus or any other appropriate writ or direction declaring the auction proceedings of the 3[rd] respondent issued in R.C.No.158/2015, dated 14.9.2015 and published in Eenadu news paper dated 16.9.2015 as illegal, arbitrary and contrary to the provisions of the A.P.Charitable, Hindu Religious Institutions and Endowments Act 1987 and the rules made there under and consequently direct the respondents to allow the petitioner to cultivate the land by extending the benefit under section 82(2) of Act…….”

2. This Court, vide order, dated 23.09.2015 has passed the following interim order:

“.....

The petitioner is entitled to participate in the auction scheduled to be conducted on 26.09.2015. However, the auction proceedings shall not be finalized for a period of four (4) weeks.”

3. Today, when the matter is taken up for hearing, none appeared for the petitioner.

4. Heard Mr.P.Srinivas, learned Assistant Government Pleader for Endowments, for the respondents.

5. On hearing the submissions of both the learned counsels and upon perusing the entire material on record, it appears that, the present writ petition is filed challenging the auction proceedings of the 3[rd] respondent issued in R.C.No158/2015, dated 14.09.2015 and published in Eenadu news paper, dated 16.09.2015.

6. On a perusal of the proceedings in R.C.No158/2015, dated 14.09.2015 issued by the 3[rd] respondent, it is observed that, the auction for enjoyment rights of the schedule lands is for a period of three years, which has ended long back. Hence, this Court is of the opinion that, nothing survives in the present writ petition for any further adjudication at this stage and hence, the same is liable to be closed.

7. Accordingly, the Writ Petition is closed. No costs.

8. As a sequel, miscellaneous applications pending, if any, shall stand closed.
