ORAL JUDGEMENT

The respondent-conductor was dismissed from service on account of recovery of excess fare from some passengers. The Labour Court considering the punishment to be excessive directed reinstatement without backwages and also punishment of stoppage of 5 increments with cumulative effect. The workman has been reinstated.

In the facts and circumstances of the case, the discretion exercised by the labour court is not required to be interfered with. Hence this petition is dismissed.

Rule is discharged.

If on account of any subsequent misconduct any new proceedings have been taken, this order confirming the award of the labour court would not come in the way.
