ORDER:
This Criminal Petition is filed under Section 482 of Cr.P.C., seeking to quash the proceedings in FIR No.596 of 2020 dated 06.09.2020 of Duvvada Police Station, Visakhapatnam City against the petitioner/accused.
2. Today, when the matter came up for hearing, learned Public Prosecutor produced a copy of instructions dated 18.12.2024 furnished by the Inspector of Police, Duvvada Police Station, Visakhapatnam City, wherein it is stated that, after completion of the investigation, a charge sheet was filed and now, the case is pending trial vide SC No.228 of 2022 before the Special Judge for SCs & STs (POA) Act Cases, Visakhapatnam City. Therefore, no cause survives in this petition, and it has become infructuous.
3. In view of the fact that a charge sheet vide S.C.No.228 of 2022 has already been filed, pending the present petition, learned counsel for the petitioner sought permission of this Court to withdraw the present petition. 4. Permission as sought for is accorded.
5. Accordingly, this Criminal Petition is dismissed as withdrawn, with a liberty to challenge the aforementioned charge sheet, if at all the petitioner is aggrieved by the same.
As a sequel, miscellaneous applications pending, if any, in this petition, shall stand closed.
