ORDER:

1. This Criminal Petition came to be filed, under section 482 of the Code of Criminal Procedure, 1973, seeking to quash the proceedings in C.C.425 of 2017 on the file of the Court of the III Additional Chief Metropolitan Magistrate at Vijayawada, Krishna District.

2. Heard learned counsel for the petitioner and the learned Public Prosecutor appearing for the 1[st] respondent/State.

3. Charge sheet came to be filed against the petitioner for the offence punishable under sections 467, 468, 471, 477-A and 420 of Indian Penal Code,1860.

4. The learned counsel for petitioner submits that having regard to the facts on issue, the presence of the petitioner may be dispensed with on every date of adjournment during the course of trial. The learned Public Prosecutor opposed the same stating that since the petitioner being the sole accused, his presence is necessary before the Court.

5. In view of the above submissions and having regard to the facts and circumstances of the case and as there is no dispute with regard to the identity of the petitioner, his presence is dispensed with before the trial court in C.C. 425 of 2017 on the file of the Court of the III Additional Chief Matropolitan Magistrate at Vijayawada, except on the dates when his presence is required by the trial court.

6. With the above observation, the Criminal Petition is disposed of.

As a sequel, miscellaneous petitions, if any, pending in this Criminal petition shall stand closed.
