(Per : MR.JUSTICE R.K.ABICHANDANI)

In this petition the provisions of Section 180 of the Gujarat Panchayats Act, 1961 were challenged. The resolution dated 14.2.1985 at Annexure "A" to the Nagar Panchayat was also challenged. That resolution related to the Octroi contract for the period from 1.4.1985 to 31.3.1986 under Section 180 of the said Act. The Act of 1961 has been repealed and replaced by the Act of 1993.

The period of one year contemplated by the resolution was also over long back. This petition has therefore become infructuous. Rule is discharged with no order as to costs.
