ORDER:-
This Criminal Petition is filed by the petitioners/A-2 and A-3 under Section 482 of the Criminal Procedure Code, 1973 to quash the proceedings in C.C.No.407 of 2019 on the file of the learned Judicial Magistrate of First Class, Chinthalapudi.
2. Heard the learned counsel for the petitioners and the learned Public Prosecutor appearing for the 2[nd] respondent – State and perused the material placed on record.
3. Charge sheet came to be filed against the petitioners for the offences punishable under Sections 498-A read with 34 I.P.C. and Sections 3 and 4 of the Dowry Prohibition Act, 1961.
4. Though various grounds are urged, learned counsel for the petitioners seeks dispensation of the presence of the petitioners before the trial Court.
5. The same is not seriously opposed by the learned Public Prosecutor as there is no dispute with regard to the identity of the petitioners.
6. Having regard to the facts and circumstances of the case and as there is no dispute with regard to the identity of the petitioners, the presence of the petitioners/A-2 and A-3 before the trial Court is dispensed with except on the dates when their presence is required by the trial Court.
7. With the above observation, the Criminal Petition is disposed of.
Miscellaneous petitions pending, if any, in this Criminal Petition shall stand closed.
