ORDER:
The present Criminal Petition is filed under Section 482 of the Code of Criminal Procedure,1973 (for brevity “Cr.P.C.”) by the petitioners 1 to 7/Accused seeking to quash the proceedings pending against them in M.C.No.4 of 2015 on the file of the Court of Tahsildar-cum-Mandal Executive Magistrate, Paravada, Visakhapatnam city concerning in Cr.No.48 of 2015 of Paravda Police Station, Visakhapatnam City.
2. The Tahsildar-cum-Mandal Executive Magistrate, Paravada, Visakhapatnam City, while considering the existing situation as on 17-03-2014 with regard to the rivalry civil dispute between the petitioners/ Party Nos. A and B on one hand and Party No.C on the other hand, has passed a quasi judicial order under Sections 107 and 145 Cr.P.C..
3. As can be seen from the record that as there were civil disputes pending between Party Nos.A, B and C in respect of the lands in question, they indulged in quarrelling each other and thereby caused public breach of peace or disturb the public tranquillity. Considering the same, the Tahsildar-cum-Mandal Executive Magistrate, Paravada, Visakhapatnam City has passed the order for good behaviour for keeping peace and public tranquillity for a period of six months in the year 2015.
In that view of the matter, since the above said order was passed way back in the year 2015, in the considered opinion of this court, nothing survives for an adjudication of this Court in this matter and no orders are required to be passed and if at all any grievance is there, the parties can agitate their rights before the appropriate court.
Accordingly, with the above observation, this Criminal Petition is dismissed as infructuous.
Miscellaneous petitions, if any, pending in this petition shall stand closed.
