ORDER:-
This petition is filed under Section 438 of the Code of Criminal Procedure, 1973 (for short “Cr.P.C.”) seeking pre-arrest bail to the petitioners/A1 and A2 in the event of their arrest in connection with Crime No. 197 of 2021 of Gollaprole Police Station, East Godavari District registered for the offences punishable under Sections 302, 201, 506(2) r/w 34 of the Indian Penal Code, 1860.
2. Heard learned counsel for the petitioners and learned Assistant Public Prosecutor for the respondent-State.
3. Learned counsel for the petitioners submits that the petitioners are innocent and there are civil disputes between the accused No.1 and deceased and the petitioners are falsely implicated in this crime, as such petitioners’ case may be considered for grant of pre-arrest bail.
4. Learned Assistant Public Prosecutor, on instructions submits that investigation is pending, and as such, the allegations made in the complaint are true. Hence, petitioners are not entitled for pre-arrest bail.
5. Taking into consideration the facts of the case and the submissions made by learned Assistant Public Prosecutor, this Court is not inclined to grant pre-arrest bail to the petitioners.
Consequently, miscellaneous applications pending, if any, shall stand closed.
