ORDER:
This Writ Petition is filed declaring the action of respondents, in seizing 98 rice bags (49 quintals) through panchanama dated 06.10.2020 in Crime No.136 of 2020, at D.No.5-100, Uppugunduru Village, N.G.Padu Mandal, Prakasam District, as illegal and arbitrary.
Petitioner claims to have been doing rice business and stocked in a rented house at D.No.5-100, Uppugunduru Village, N.G.Padu Mandal, Prakasam District. On 06.10.2020, the MRI, N.G.Padu inspected the subject premises and seized 49 quintals of rice in 98 bags alleging that it is PDS rice and initiated proceedings under Section 6-A of the Essential Commodities Act and registered Crime No.136 of 2020. He contends that, despite his representations dated 27.10.2020 and 03.12.2020 to respondent No.3, seeking release of the seized rice, no orders have been passed thereon. Hence the Writ Petition.
Learned Government Pleader for Civil Supplies would submit that the representation filed by the petitioner before respondent No.3 would be disposed of within one week.
In the circumstances, the Writ Petition is disposed of directing respondent No.3 to dispose of the representation dated 03.12.2020 made by the petitioner, seeking release of 49 quintals of rice, within one week from the date of receipt of a copy of this order. No order as to costs.
Consequently, miscellaneous application, if any, shall stand closed.
