The Court made the following order:

- The above contempt case is filed complaining of violation[of][ the][ order]dated 22.12.2011in W.P.No.22936 of 2011.

4. In the affidavit filed in support of the contempt case,it was pleaded thatdespite the receipt of a copy of the order, the respondents failed to pass anorder.despite the receipt of a copy of the order, the respondents failed to pass anorder.

Today, when thematterislisted,SriSaiHarsha,learnedcounselrepresentingSriK.V.Raghuveer,learnedcounselfortherespondentsproduced a copy of the order passed by the Project Officer,Rajiv VidyaMission (SSA), Kurnool, vide Rc.No.E-5/AE’s/EW/2011-12 dated 28.04.2013,whereinit was statedthat the petitioners arenot eligible for the subjectallowances and in fact the order was communicated to the petitioners.representingSriK.V.Raghuveer,learnedcounselfortherespondentsproduced a copy of the order passed by the Project Officer,Rajiv VidyaMission (SSA), Kurnool, vide Rc.No.E-5/AE’s/EW/2011-12 dated 28.04.2013,whereinit was statedthat the petitioners arenot eligible for the subjectallowances and in fact the order was communicated to the petitioners.

7. SriBabji,learnedcounselforthepetitioners,submittedthatthepetitioners did not receive a copy of the order.petitioners did not receive a copy of the order.

8. A copy of the orderis handed over to the learned counselfor thepetitioner across the bar.petitioner across the bar.

Given the facts and circumstances of the case, since a speaking order-was passed by the Project Officer in pursuance of order dated 22.12.i911,though some delay occurred,in the considered opinionof thiscourt,thewas passed by the Project Officer in pursuance of order dated 22.12.i911,though some delay occurred,in the considered opinionof thiscourt,the resp'ndents did not commit any contempt, by not implementingthe orderdated 22.12.2011in W.P.No.22936 of 2011.

Therefore, this contempt case is closed, giving liberty[to][ the][ petitioners]to challenge the speaking order passed by the Project[Officer,][ Rajiv][ Vidya]Mission (SSA), Kurnool, vide Rc.No.E-5/AE’s/EW/2011-12[dated][ 28.04.2013.]No costs.to challenge the speaking order passed by the Project[Officer,][ Rajiv][ Vidya]Mission (SSA), Kurnool, vide Rc.No.E-5/AE’s/EW/2011-12[dated][ 28.04.2013.]No costs.

As a sequel, pending miscellaneous petitions, if any,[shall][ stand][ closed.]
