ORDER:
This writ petition is filed under Article 226 of the Constitution of India, to issue Writ of Mandamus to declare proceedings dated 23.06.2007 vide ROC No.1239/2006 (B) as well as Award No.11/2007 passed by the third respondent/Revenue Divisional Officer-cum-Land Acquisition Officer, Narsapur Division, insofar as land of an extent of Ac.0-72 cents in R.S.No.326/9 of Vissakoderu Village, Palakoderu Mandal, West Godavari District, as illegal, arbitrary and contrary to the provisions of Land Acquisition Act and consequently to set aside the same.
Though the petitioner made certain allegations for non-issuance of notice to the legal heirs of the original owner who died long ago, but at the stage of admission, learned counsel for the petitioner requested to permit the petitioner to make a representation to set apart the land of an extent of Ac.0-72 cents in R.S.No.326/9 of Vissakoderu Village, Palakoderu Mandal, West Godavari District, for communal purposes.
But, this Court cannot decide such an issue, as the award is already passed. However, liberty is given to the petitioner to make a representation to the authorities concerned and on submission of such representation, the authorities are directed to dispose of the same in accordance with law within one month thereafter.
With the above direction, writ petition is dismissed as not pressed. No costs.
Consequently, miscellaneous applications pending if any, shall stand closed.
