THE HON’BLE SMT JUSTICE KONGARA VIJAYA LAKSHMI WRIT PETITION No.3574 of 2014

ORDER:

The Writ Petition is filed questioning the action of the respondents in not considering the petitioners’ applications dated 15.06.2013 for regularization of the existing Fresh Water Aquaculture Fish Ponds in Sy.Nos.1242/1, 1242/2 to an extent of Ac.5.40 cents, situated at Gurvaipalem, Kalidindi Mandal, Krishna District, as per G.O.Ms.No.7, dated 16.03.2013 as arbitrary and illegal.

When the Writ Petition came up for admission on 18.02.2014, the following interim order is passed; “Heard the learned counsel for the petitioner.

It is stated that this court, in similar circumstances, granted interim direction in WPMP No.236 of 2014 in W.P.No.217 of 2014. In view of the same, there shall be interim direction to the respondent authorities to permit the petitioners to undertake repairs in their existing fish tanks strictly in accordance with the terms and conditions stipulated in G.O.Ms.No.7, dated 16.03.2013.”

The learned Government Pleader does not have instructions in this matter as to whether the applications filed by the petitioners on 15.06.2013, seeking regularization of Fresh Water Aquaculture Fish Ponds are, in fact, considered by the Department or not.

In the facts and circumstances of the case, if the said applications dated 15.06.2013 filed by the petitioners are received by the competent authority and if the same are in accordance with Rules and if the same are valid applications as on today and not disposed of, the official respondents are directed to dispose of the same strictly in accordance with law.

The Writ Petition is disposed of accordingly. There shall be no order as to costs.

As a sequel, interlocutory applications pending, if any, shall stand closed.
