ORDER:-
This Criminal Petition is filed by the petitioner/A-9 under Section 482 of the Criminal Procedure Code, 1973 to quash the proceedings in C.C.No.215 of 2019 on the file of the learned Judicial Magistrate of First Class at Kurnool, Kurnool District.
2. Heard the learned counsel for the petitioner and the learned Public Prosecutor appearing for the 1[st] respondent – State and perused the material placed on record.
3. Charge sheet came to be filed against the petitioner for the offences punishable under Sections 498-A and 323 read with 34 I.P.C. and Section 4 of the Dowry Prohibition Act, 1961.
4. Though various grounds are urged, learned counsel for the petitioner seeks dispensation of the presence of the petitioner before the trial Court.
5. The same is not seriously opposed by the learned Public Prosecutor as there is no dispute with regard to the identity of the petitioner.
6. Having regard to the facts and circumstances of the case and as there is no dispute with regard to the identity of the petitioner, the presence of the petitioner/A-9 before the trial Court is dispensed with except on the dates when her presence is required by the trial Court. However, this order does not preclude the petitioner from making an application seeking discharge, if permissible under law.
7. With the above observation, the Criminal Petition is disposed of.
Miscellaneous petitions pending, if any, in this Criminal Petition shall stand closed.
