ORDER:

This writ petition is filed, under Article 226 of the Constitution of India, seeking to declare the action of the 2[nd]respondent in withdrawing Letter of Intent dated 30.6.2017 for the proposed RGGLV LPG Distributorship at Tarlupadu, Prakasam District, without any reasoned show cause notice, as illegal.

2. Heard the counsel for the petitioner and Sri Dominic Fernandes, Standing Counsel for the respondents.

3. The counsel for the petitioner submits that there was a draw for selection of LPG Distributorship at Tarlupadu wherein the petitioner was selected and Letter of Intent was given on 30.6.2017, as there was a writ petition filed challenging allotment to the petitioner. He submits that after LoI was given to the petitioner, he started activity to make constructions after obtaining necessary permissions from the concerned departments. There was consequent delay in commissioning the activities. The petitioner also gave reply dated 29.11.2019 to the letter of withdrawal dated 18.11.2019 issued by the 2[nd]respondent, but his reply is not considered.

4. Hence, in view of the above circumstances, this Court deems it fit to direct the respondents to consider the reply dated 29.11.2019, keeping in view the fact that the petitioner did not wantonly cause any delay in commencing the activities, and pass appropriate orders, within a period of four (4) weeks from the date of receipt of a copy of this order.

5. The writ petition, with the above direction, is disposed of. As a sequel, miscellaneous petitions pending consideration if any in the writ petition shall stand closed.
