ORDER :
It is brought to the notice of this Court by the learned counsel for the petitioner, so also the learned Additional Public Prosecutor Sri S.Dushyantha Reddy, that earlier, accused Nos.2 to 9 in the same crime No.277 of 2019 of Mannur police station, approached this Court by way of filing Criminal Petition No.7247 of 2019, and this Court, vide order dated 28.11.2019, disposed of the said Criminal Petition. Copy of the said order is filed along with this Criminal Petition as material paper. Operative portion of the said order reads as under:
“While holding that there is no ground to quash the entire proceedings at this stage, the police are given liberty to continue their investigation, however, they should scrupulously follow the procedure under Section 41-A of Cr.P.C. and also the guidelines laid down by the Hon’ble Supreme Court judgment in Arnesh Kumar v. State of Bihar and another {(2014) 8 SCC 273}.”
Following the said order and for the reasons recorded therein, this Criminal Petition is also disposed of in terms thereof. Office to enclose a copy of the said order.
Miscellaneous Petitions pending, if any, in the Criminal Petition shall stand closed.
