ORDER:

The Writ Petition under Article 226 of the Constitution of India is filed seeking to issue a Writ, order or direction declaring the proceedings dated 20.12.2015 of the 2[nd] respondent and consequential action of the 3[rd]respondent in proceeding with the disposal of the seized stock in public auction as illegal and arbitrary.

Heard the learned counsel for the petitioner and the learned Government Pleader for Civil Supplies appearing for the respondents.

Considering the submissions of the learned counsel for the petitioner and on perusal of the material available on record, this Court has granted interim stay of sale of the seized stock until disposal of proceedings under Section 6-A of the Essential Commodities Act, 1955.

Both the learned counsel for the petitioner as well as the respondents are unable to place any latest information with regard to 6-A proceedings.

In view of the above interim direction, no further orders are required to be passed in this Writ Petition.

Hence, the Writ Petition is disposed of giving liberty to the respondents to proceed in accordance with law if 6-A proceedings are completed.

Miscellaneous petitions pending, if any, in this Writ Petition shall stand closed.
