ORDER :
This Criminal Petition is filed under Section 439 of the Code of Criminal Procedure,1973 (for short ‘Cr.P.C’) to enlarge the petitioner on bail.
2. The petitioner is Accused No.1 in Cr. No. 69 of 2019 of Chinturu Police Station.
3. The alleged offence against the petitioner is under Section 8 (c) r/w 20 (b) (ii) (C) of NDPS Act.
4. It is the case of the prosecution that the petitioner along with A.2 to A.5 was found on 19.08.2019 to be illegally transporting 150 kgs of ganja and at that time, they were apprehended and arrested. The contraband was also seized by the police. Therefore, the petitioner has committed the aforesaid offences.
5. Heard learned counsel for the petitioner and the learned Additional Public Prosecutor.
6. Perused the record.
7. The quantity of ganja involved in this case is 150 kgs, which is a commercial quantity. The record reveals that the accusation made against the petitioner, prima facie, is well founded. There is no material to presume that the petitioner is not guilty of committing the said offences. The investigation in this case is still pending and charge sheet is not filed.
Therefore, in the said facts and circumstances of the case, this Court do not see any valid ground to enlarge the petitioner on bail at this stage.
8. In the result, the criminal petition is dismissed.
