Thepetitionerhasfiledtheinstantpetitionfor following reliefs:- “1.That,theStateLeveiHighPowar. CasteVerification Committee may be tiirected t0 verify andaffirmtheCasteCertiticateof[“Momin]Julaha”,asOtherBackwardCiassCategoryissuedtothe> petitionerbythecompetentauthorityandwithoutcompelling her to produce the documents prior to year1970 of her forefathers.

2. That,theRespondentAuthoritiesmaybedirectedto give appointmentto the petitioner on thepostofAssistantEngineer(Trainee)intheStatedirectedto give appointmentto the petitioner on thepostofAssistantEngineer(Trainee)intheStateEiectricityBoardasperherselection/appointmentorder under Other Backward Class category.order under Other Backward Class category.

Grievance of the petitioner is that she was selected forappointmenton the post of Assistant Engineer (Trainee) inthe State Electricity Board, however Vide order of Annexure (Trainee) inthe State Electricity Board, however Vide order of AnnexureP—2,she wasdirectedto submit following documentsby10th of August, 2007:—10th of August, 2007:—

(i) CertificatefromSCfST/OBCHighPowerVerificationCommitteeregardingverificationofPCC submitted by her.

(ii) Final year marksheet.

ThepeiitionerapproachedtheCasteScrutinyCommittee for verification of her castecertificate, howeverthe respondent No.4 demanded 1and records and schoolcertificateeof her forefatherspriorto year1970andfornon—submission of the same. her caste certificate was notverified. She filed a writ petition against the demand of landrecordspriortoyear1970,howeverthepetitionwasdismissedasprematureasnoorder was passed on herapplication.

Duringthecourseofargument,ShriMajumdar,learned counsel appearing for the petitioner, apprised thatshe hadpreferredWrit AppealNo.56/2008againsttheorderdated7—2—2008passedinW.P.(S)No.56'7j200‘7,however the same was dismissed as withdrawn with libertvof tiling another writ petition challenging the action of therespondentNo.3innotpassinganyorderontheappellant’sreplydated12-2—2008inspiteof lapseof aperiod[of][ more][ than][ two months,][ though][ the]petitioner[has]not disclosed filing of writ appeal and its dismissal with the‘aforesaid libertV:

The earlier writ petition filed by the petitioner[based]on the same cause of action was[ dismissed][by][ this][ Court]videorder dated7-2~2008withanobservationthat[“the]petitionis prematureas nofinalorder has been passedwhichcouldbeimpugnedinthispetition,invokingofthisCourtunderArticle226ofthejurisdictionConstitutionofIndia”.Accordingly,thepetitionwasdismissedandtheinterimreliefgrantedearlierwasdischarged.
