ORDER :

This Criminal Petition, under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, is filed by the petitioner/A1, seeking regular bail, in Crime No.51/2024 of Gangaraju Madugula Police Station, Alluri Sitharamaraju district.

2) A case has been registered against the petitioner and others for the offences punishable under Sections 20(b)(ii)(C), 25 read with 8(c) of NDPS Act.

3. The case of the prosecution in brief is that on 15.11.2024 at about 09.00 hours, on credible information about illegal possession and transportation of ganja, the Station House Officer of G.Madugula Police Station, Alluri Sitharamaraju District along with staff and others went to Nurmathi Village Junction, Nurmathi Panchayat, G.Madugula Mandal and found accused no.1 in possession of 200 kgs of ganja in five white colour plastic bags. Police seized the ganja and on enquiry accused no.1 disclosed his identity particulars and later he was arrested and got remanded to judicial custody.

4. Heard. Perused the record.

5. The quantity of contraband allegedly seized from the possession of the petitioner is 200 kgs of ganja which is a huge quantity. Learned Assistant Public Prosecutor submits that the case is still under investigation and it is at nascent stage and some more witnesses are to be examined. Hence, this Court is not inclined to grant bail to the petitioner at this stage as the investigation is not yet completed.

6. Accordingly, the Criminal Petition is dismissed.

As a sequel thereto, the miscellaneous petitions, if any, pending in this Criminal Petition, shall stand closed.
