ORAL ORDER

1. Rule. Learned APP Ms. Jirga Jhaveri waives service of rule on behalfof respondent – State.

2. Learned Advocate Shri Shrey M. Dave for the applicant submits thatgrandfather of the applicant had expired on 20.12.2020 and whereas parentsof the applicant have predeceased the grandfather and therefore presenceof the applicant is required to conduct after death rituals of his lategrandfather.

3. Learned Additional Public Prosecutor has opposed the applicationand has further submitted that even if temporary bail is granted then thesame could be subject to the certain conditions so as to ensure that theapplicant surrenders in time.

4. Considering the submissions of the learned Advocate and the learned APP, I am inclined to allow this application. The applicant shall bereleased on temporary bail for a period of one week starting from31.12.2020, on executing personal bond of Rs.10,000/- (Rupees TenThousand) before the Jail authority and on usual terms and conditions asmay be imposed by the Jail Authority.

The applicant to surrender before Jail Authority on completion oftemporary bail, without fail. Rule is made absolute to the aforesaid extent.

5. After the completion of temporary bail period, the Jail Authoritiesshall admit the applicant in jail after strictly following the Circular dated03.06.2020 relating to COVID-19 issued by the Superintendent of Jail,Ahmedabad.

Registry is directed to communicate this order to the concerned JailAuthority by fax / email message today itself.
