-------------------------------------------------------------- MANIBHAI BHAGABHAI PARMARVersus STATE OF GUJARAT -------------------------------------------------------------- Appearance: None present for Petitioner MR HL JANI for Respondents No. 1, 2, 3, 4 -------------------------------------------------------------- CORAM : MR.JUSTICE S.K.KESHOTE Date of decision: 02/12/97
ORAL JUDGEMENT 1. The matter was called out for hearing in the first round in first sitting then in the second round and lastly in the third round in second sitting but none put appearance for the petitioner. Perused the special civil application and heard the learned counsel for the respondents.
2. The petitioner, a Head Constable of the Police Department, filed this special civil application and prayer has been made for quashing and setting aside of the action of the respondents declaring the petitioner as failed in the oral test of the departmental examination for promotion to the post of Police Sub-Inspector.
3. In the oral test which consists of 150 marks, a candidate has to obtain 75 marks so as to qualify himself in the said oral test. The petitioner admittedly secured 72.4 marks in the oral test. So he could not qualify in the oral test. The petitioner has prayed for giving him the grace marks but failed to show any statutory rule or resolution of the Government providing the same.
4. This writ petition is wholly misconceived and the same is dismissed. Rule discharged. Interim relief, if any, granted by this Court stands vacated. No order as to costs.
