ORDER:

WRIT PETITION NO.31106 OF 2021

This writ petition is filed under Article 226 of the Constitution of India seeking the following relief:- “..to issue an appropriate writ order or direction more particularly one in the nature of writ of Mandamus declaring the action of the respondents No.4 to 6 in not implementing the orders of the 3[rd] respondent vide proceedings No.R Dis E6/1460/2021 dated 06.11.2021 by deleting the petitioner land with an extent of admeasuring Ac.5.60 cents comprised in Sy.No.176 situated at Tegacherla village, Rapur Mandal, SPSR Nellore District from the list of prohibited property under Section 22(A) of the Registration Act by showing the above lands in prohibitory list as arbitrary, illegal against Art. 14, 21 and 300-A of the Constitution of India apart from violative of provisions of the Andhra Pradesh Dotted Lands (Updation in Re-settlement Register) Act 2017 and Rules thereunder and consequentially direct the 5[th] respondent to receive, register and release the documents presented by the petitioner in respect of the above said land by deleting the above said lands from the prohibited property list as per the proceedings of the 3[rd] respodent DT: 06.11.2021 and pass such other order or orders..”

Though the petitioner made several allegations against the respondents, during hearing, learned counsel for the petitioners requested this Court, without touching the merits of the case, to issue a direction to the respondents to receive and register the document(s) presented by the petitioners.

Learned Assistant Government Pleader for Stamps and Registration readily agreed to receive and process the document presented by the petitioners, in accordance with law.

In view of the above, respondents are directed to receive and process the document submitted by the petitioners, in accordance with law. In case the instrument presented cannot be registered, the Registrar shall pass reasoned order as mandated under Section 71 of the Registration Act, as it is appealable under Section 72 of the Registration Act.

With the above direction, writ petition is disposed of. No costs.

Consequently, miscellaneous petitions pending, if any, shall also stand closed.
