ORAL JUDGEMENT

Heard learned counsel for the parties and perused the order of this court dated 17/3/99.

The learned counsel for the petitioner submits that this court may give direction to the court below to decide the suit expeditiously. I find from the order of this court dated 17/3/99 that this court has directed the trial court to decide the suit within one month from the date of the receipt of the writ of the order or the certified copy whichever is earlier but that order has not been complied with by the court below.

The learned counsel for the parties submit that the suit has not been decided so far. This court has in the facts of the case given directions for early disposal of the suit. But it is really shocking that the court below has not taken the matter seriously. The trial court was also directed to report the compliance of the order dated 17/3/99. I do not find anything on the record of this Civil Revision Application also in this regard. The learned trial court has directed to give out the reason why the order dtd.17/3/99 was not complied with. His explanation has to reach to this court within a period of 15 days from the date of the receipt of the writ of this order.

The learned Trial Court is further directed to dispose of the suit within 2 months from the date of the receipt of the writ of this order or its certified copy thereof whichever is earlier. The compliance of this order has to be reported to this court.

The Civil Revision Application and Rule stand disposed of accordingly with no order as to costs.
