JUDGMENT:
1. Today when the matter is taken up for hearing, learned counsel appearing for both sides is present.
2. Learned counsel for the respondent/plaintiff would contend that appellant/defendant delivered the possession of the schedule property to the respondent/plaintiff, the cause has become infructuous in the present matter and it may be closed.
3. Learned counsel for the appellant/defendant represented that his client is not in touch with him.
4. By recording the submissions made by the learned counsel for the respondent/plaintiff, the Second Appeal is closed as infructuous. There shall be no order as to costs.
As a sequel, miscellaneous petitions, if any pending, shall stand closed.
