Commissioner of Central Excise & Customs (Appeals) disposed of the stay application and hence, the present petition is preferred. It is submitted before us that there is a Circular, which was required to be taken into consideration by the Appellate Authority. It is submitted that in our order dated 31.7.2000, we have into consideration by the Appellate Authority. It is submitted that in our order dated 31.7.2000, we have indicated that the documents were filed along with the appeal memo and those documents ought to have been taken into consideration. We are not expressing any opinion on the merits or demerits of the case as the learned counsel appearing for the Revenue fairly stated that this is an order which requires reconsideration. Under the circumstances, we quash and set aside the impugned order Annexure `C' dated 11.4.2000 and direct the Commissioner (Appeals) to dispose of the stay application afresh considering the Circular and the pleadings and documents produced.

Special Civil Application stands allowed accordingly. Rule is made absolute with no order as to costs.
