Heard Sri M.K.Raj Kumar, learned Counsel appearing[on][ behalf][ of][ Sri]P.NarahariBabu,learnedCounselforthePetitionerandSriK.ArjunChowdary, learned Assistant Government Pleader.

The present Writ Petition is filed with the following prayer; "In the circumstances and for the reasons stated above,it istherefore prayed that this Hon’ble Court may be pleased[to] issue[ a]Writ, One in the nature of a Writ of Mandamus or any[other]appropriate Writ, Direction or Order questioning the action of the[ 4"^]respondentinentertainingappealinRc.No.351/2015/Bforcancellation of Pattadar Pass Book and Title Deed Book grantedinfavour of petitioner in respect of land an extent of Ac.2.84 cent InSy.No.5-2 and an extent of Ac. 2.03 cents in Sy.No.4-3 sitatued[ at]ThungoduVillage, Somandepalli Mandal,Sri Satya SalDistrictErstwhile Anantapur District filed by the respondents 6[ to] 9 hereinand sought mutation of their names in respect of the same withoutmentioning provision of law though landis an assignedlandassignedinfavourofpetitioner’shusbandvideDAP.Dis.No.185/1403 dated 10.02.1994 as illegal,arbitrary[and]violative of Article 14,21, 300-A of constitution of India and contraryto the provisions of the A.P Rights in Land and Pattadar PassBooks Act, 1971 and consequently set-aside the same and furtherdirect the respondents 1 to 5 herein not to dispossess the petitionerfrom above said land and pass such other order or orders as thisHon’ble Court may deem fit and proper in the circumstances of thecase.

It transpires from the record that the Unofficial Respondent Nos.6 to 9havefiledan Appealbefore the RevenueDivisionalOfficer,Penukondabearing R.C.351/2015/B (Ex.P3).It appears that this Appeal has been filedon28.02.2015 and the same has been pending on the fileof theRevenueDivisional Officer, Penukonda. Learned Counsel for the Petitioner submits thatthe said Revenue Divisional Officer (Respondent No.4)[had][ issued][ Notices][ to]the Petitioner on 06.08.2024 (Ex.P2) and 27.11.2024 (Ex.P1) directing him toappear in the enquiry. This Court has perused the copy of the Appeal (Ex.P3)

and the Writ Petitioner hereinis arrayed as Respondent[No.1]in thesaidAppeal.

4. This Court fails to understand as to why in the Appeal[which][ was][ filed]on28.02.2015,forthefirst timeNoticeshavebeenissuedtotheWritPetitioner only in the year 2024. Learned Counsel for[the][ Petitioner][ submits]that the said Appeal is not maintainable without there being a challenge of anyorder of the Tahsildar. He would also contendthat[the][ Writ]Petitioner hasbeen holding the Pattadar Pass Book and Title Deed in respect of the subjectland since 1973 onwards and therefore the Appeal bearing[R.C.351/2015/B](Ex.P3) is also barred by limitation.on28.02.2015,forthefirst timeNoticeshavebeenissuedtotheWritPetitioner only in the year 2024. Learned Counsel for[the][ Petitioner][ submits]that the said Appeal is not maintainable without there being a challenge of anyorder of the Tahsildar. He would also contendthat[the][ Writ]Petitioner hasbeen holding the Pattadar Pass Book and Title Deed in respect of the subjectland since 1973 onwards and therefore the Appeal bearing[R.C.351/2015/B](Ex.P3) is also barred by limitation.
