ORDER:(per Hbn'ble Sri Justice M. Ganga Raoj The challenge in this writ petition is to the order dated 23.12.2002 passed by the Andhra Pradesh Administrative Tribunal at Hyderabad in 0A.No.11396 of 2002.

2. Heard learned Government Pleader for Services-I appearing for the writ petitioners.

The grievance of the respondents is that initially they were appointed as police constables in the police department and retired from service in different cadres on attaining age of superannuation on different dates. After their appointment, they were given pay scales and put on probation for a period of three years while other similarly situated persons working in APSP were given higher scale of pay and increments etcetera. Being aggrieved by the same, some of the persons approached the Tribunal by way of filing 0A.No.3180 of 2002 and batch. The Tribunal by its order dated 22.03.2002 disposed of the said OA.No.3180 of 2002 and batch. As the respondents herein are similarly situated to that of the applicants in 0A.No.3180 of 2002 filed the present OA to extend the benefit extended to the applicants in OA. No.3180 of 2002 and batch. The Tribunal, following the orders in RP.No.24090 to 24157 of 1989 and WP.No.406 and 6208 of 2000 directed the respondents therein - petitioners herein to consider the case of the respondents herein-applicants to consider the cases of the applicants in accordance with G.O.Ms.No.280, dated 13.12.2001. Instead of considering the case of the respondents, the present writ petition is filed. This Court while admitting the writ petition granted interim stay of the order impugned by order dated 22.12.2006. Notices were served on some of the respondents and notices were not served on other respondents. For non service of notice on other respondents, this writ petition was dismissed against them viz., respondents 2,5,7,9,10 & 11. Inspite of service of notice on other respondents, no appearance is made perhaps because they retired from service long back, even before approaching the Tribunal in the year 2002. The case of the writ petitioners is that the respondents are entitled for weightage of their probationary period being considered for applying the revised pay scales of 1969 with effect from the date of their training and other emoluments along with others. In these circumstances, considering the facts and circumstances of the case, submissions of the learned Government Pleader and perusal of the record, we feel it appropriate to dispose of the writ petition directing the petitioners to consider the case of the respondents and pass appropriate reasoned order, as per the orders of the Tribunal, within a period of eight weeks from the date of receipt of a copy of this order and communicate the same to the respondents.

4. Accordingly, the Writ Petition is disposed of with the above directions. There shall be no order as to costs.

As a sequel, pending miscellaneous applications, if any, shall stand closed.
