ORDER:

THE HON’BLE SRI JUSTICE NINALA JAYASURYA

WRIT PETITION No.25666 OF 2020

This Writ Petition is filed under Article 226 of Constitution of India for the following relief/s:

“… to issue a Writ, Order or direction more particularly one in the nature of Writ of Mandamus to declare the action of the respondent Nos.3 in not issuing the pattedar pass book and title deeds cum E-pass book on the application No.RMU012005946054 of the petitioner dated 15.12.2020 under Form-6(A) in respect of the agricultural land in survey No.6 an extent of Ac 5.00 cents situated at Esalapuram Village, Puttur Mandal, Chittoor District as illegal, arbitrary and consequently direct the 3[rd] respondent to issue pattedar pass book and title deed cum E-pass book in favour of petitioner in respect of the agricultural land in survey No.6 an extent of Ac 5.00 cents situated at Esalapuram Village, Puttur Mandal, Chittoor District and pass such other order or orders…”

2. Heard learned counsel for the petitioner and learned Assistant Government Pleader for Revenue.

3. The grievance of the petitioner in the present Writ Petition is that despite of making applications in Form-6A on 15.12.2020 for issuance of pattadar pass book, no action is being taken by the 3[rd] respondent. Hence, the present Writ Petition.

4. When an application is made for issuance of pattedar pass books and title deeds, the concerned officer i.e., the 3[rd] respondent-Tahsildar is required to consider the same and take appropriate action. Since, it is specifically averred in the Writ Petition that such applications are made and pending consideration before the 3[th] respondent, without going into the merits of the case, the Writ Petition is disposed of with a direction to the 3[rd] respondent to take appropriate action on the petitioners applications dated 15.12.2020 in accordance with law and intimate the same to the petitioner, within a period of eight (8) weeks from the date of receipt of copy of this order.

6. With the above direction, this Writ Petition is disposed off. No costs.

As a sequel thereto, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
