ORDER:-
The case of the petitioners in the present writ petition is that though the petitioners are the absolute owners and processors of the subject lands, the respondent authorities are interfering with their possession and enjoyment in respect of the subject properties. According to the learned counsel for the petitioners, the respondents herein have not issued any notice.
In order to show their prima facie title and right over the properties, the petitioners have filed 1B register, pattadar pass books and pattas also granted by the authorities.
It is settled and well established principle of law, that no citizen of this country shall be deprived of his/her right to property except in accordance with the procedure established by law.
In view of the prima facie material produced by the petitioners, this Court deems it appropriate to dispose of the writ petition, directing the respondents not to interfere with the possession and enjoyment over the subject properties except in accordance with law. It is further made clear that if the lands of the petitioners herein are required for any public purpose, the respondents can initiate appropriate proceedings, if they are so advised. There shall be no order as to costs.
Consequently, miscellaneous petitions pending, if any, shall also stand closed.
